Medical Support

The law provides that in addition to child support the court can determine who will provide for the uninsured medical expenses of the children. This sum is not set by formula. It is at the discretion of the Judge. Typically parents will share uninsured expenses equally, but if one parent has significant income it may not be fair to expect the other parent to shoulder half of the uninsured expenses. This is something that attorneys need to address in settlement or at trial.
